This Website, pt78.space, is operated by PT78 — Ivan Hrebinchenko, individual entrepreneur registered in Ukraine, correspondence address Poznańska 37, 00-689 Warsaw, Poland (“PT78”, “we”, “us”).

These Terms of Use govern your access to and use of this Website. By using the Website you accept them. If you do not accept them, please do not use the Website.

These Terms govern the Website only. The provision of paid services is governed by our Public Offer Agreement or by an individual written contract.

2. Eligibility

The Website is intended for business users acting in a professional capacity, aged 18 or over. By using it you confirm that you meet these conditions and, where you act for an organisation, that you are authorised to do so on its behalf.

3. Permitted Use

You may view the Website, submit enquiries, book consultations and download materials we make available, for your own business purposes. You must not:

use the Website for any unlawful, fraudulent or harmful purpose;
copy, reproduce, republish, sell or exploit any part of the Website commercially without our written consent;
use automated systems — scrapers, bots, crawlers — to extract data from the Website beyond ordinary search-engine indexing;

You are responsible for anything you send us through the Website. You must not submit content that is unlawful, defamatory, infringing, misleading or confidential to a third party without authority.

By submitting material, you grant us a non-exclusive, royalty-free licence to use it as necessary to respond to your enquiry and to provide any service you request. We treat commercially sensitive information you send us as confidential.

The Website links to and embeds third-party services, including a scheduling tool. We do not control these services and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damage, or for any loss of profit, revenue, business, goodwill, data or anticipated savings, arising out of or in connection with your use of the Website, whether based in contract, tort, negligence or any other legal theory, even if we have been advised of the possibility of such damage.

Our total aggregate liability arising out of or in connection with the Website is limited to one hundred euros (EUR 100).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

Because the Website is directed at business users, statutory consumer protections do not apply.

You agree to indemnify us against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these Terms or your unlawful use of the Website.

The courts of Ukraine have exclusive jurisdiction, save that we may bring proceedings in the courts of your place of establishment where necessary to protect our rights.

15. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the documents referred to in them, constitute the entire agreement between you and us in respect of the Website.
